DMX Facing Jail Time

Rapper DMX is looking at prison time after pleading guilty to violating the terms of his conditional release from an earlier charge. The hip hop star (whose real name is Earl Simmons) was originally arrested back in June 2004 for an incident at New York's JFK Airport in which he allegedly impersonated a federal agent and attempted to steal a car.

Simmons pleaded guilty in December of last year to reckless endangerment on the charge and was given the aforementioned conditional release. However, the rapper was soon in trouble again -- once for driving over 100mph near his home a week after his release and again a few months later in relation to a traffic accident in the Bronx involving an unmarked police car.

On Tuesday, Simmons pleaded guilty in a New York courtroom as part of a plea deal between his lawyer and the New York District Attorney. The deal will still see the rapper serve time, but the expected 60 day sentence falls well short of the maximum one year in jail that Simmons was originally facing.

Simmons' sentencing hearing will be held on November 17. His lawyer, Murray Richman, said he expects that the rapper will ultimately serve 40 days of the expected sentence, likely at New York's Rikers Island prison. "Under the circumstances," said Richman, "this was the best we could possibly hope for."
